Property Owners Should Take Heed of the New Digital Title Deeds Regulations
By Bright Maponga
Are you a property owner, (i.e.) do you have any title deed registered in your name(s) or company? If so, the time to act is now!
The law, as per the new Deeds Registries Regulations, 2025, requires that holders of old title deeds submit them within 24 months for validation process by the Deeds Registry and issuance of the new securitized deeds thereof.
The process would require one to submit copies of their old title deeds to the deeds registry, which may request additional information. During submission of the copies, one is further required to furnish the Registrar with the original copies of the old title deeds for verification purposes.
Upon successful validation of the old title deeds, the Registrar shall issue securitised deeds to the respective owners printed on a securitised paper.
The old title deeds shall be handed over to the deeds registry upon collection of the new securitised title deeds. The securitised deeds shall be both in electronic format and printed form.
The failure to act accordingly within the stipulated time will result in the old title deeds not being legally recognised. It entails that one will not be able to legally transact and/ or do any other action based on those old title deeds.
